Day Three Of Trial Proceeds

ST. CLAIRSVILLE - Martins Ferry Police Chief Barry Carpenter repeatedly told a special agent investigating the theft case against him involving the surrogate mother for a Hollywood couple that he thought "it was all a joke."

In court this morning, Carpenter, who has been suspended from the police force while the case is heard in a Belmont County courtroom, repeatedly said in a taped conversation with Ohio Bureau of Criminal Identification and Investigation Special Agent Mark Rohrer that he did not do anything wrong.

Carpenter said that he was only joking with the celebrity photographers who came to the area seeking photographs and other information about surrogate mother Michelle Ross, the local woman who served as surrogate mother for the twin daughters of Hollywood actors Matthew Broderick and Sarah Jessica Parker,

The tapes were played as part of the prosecution's case against Carpenter who is facing burglary, theft in office and other related felony charges. In those taped conversations, Carpenter said many people in the police department and the community knew where Ross lived in Martins Ferry and that there were items in the house for which the tabloid photographers were willing to pay.

Carpenter reportedly asked to take a lie detector test during those recorded conversation.

Jurors were behind closed doors Tuesday when Judge John M. Solovan ruled that Carpenter's recorded comments regarding the lie detector test will not be heard. He said polygraph evidence is not permissible in court.

Defense attorney Dennis McNamara cited a prior decision by an Ohio judge and argued that if the prosecution can use a portion of a recording to forward its case, the defendant should have the opportunity to present the remainder of that recording in his defense. Special Prosecutor Shawn Hervey said Tuesday that the results of Carpenter's lie detector test were inconclusive.

Carpenter said he called Belmont County Prosecuting Attorney Chris Berhalter to tell him about what the chief perceived as "an ethical issue." Carpenter again repeatedly said he did not believe he had done anything wrong.

Meanwhile, Ross was expected to testify today. Proceedings started nearly an hour later than planned this morning due to audio technical difficulties in the courtroom.

Testimony was expected to continue late into the day.

Berhalter and Rohrer were expected to testify as well.

Carpenter is accused of burglarizing Ross' Martins Ferry home and attempting to sell stolen items that identified her as the surrogate to celebrity photographers.

Bridgeport Police Chief Chad Dojack, who is on administrative leave from his position, also is accused of taking part in the alleged crime.

Rohrer testified Tuesday that BCII planned a sting operation after a pair of celebrity photographers told investigators Carpenter approached them in May in a Bridgeport parking lot and attempted to sell them items taken from the Ross home.

Rohrer said the sting operation would have involved those photographers returning to the area to ask Carpenter if he still would be willing to sell items taken from Ross. Rohrer said that sting operation did not take place because he believed Carpenter had become aware he was under investigation.

Those photographers testified Tuesday that they met with Carpenter and that he offered to sell them some of Ross' personal belongings; however, both said they never saw any of the allegedly stolen items in Carpenter's possession.

Whether or not the jury finds Carpenter guilty, he should be fired. His lack of good judgement and his immature behavior with regard to "joking" around with outsiders prove that he is incapable of running a professional police department.

And the youthful "chief" in Bridgeport? Do people not see how he got the job? Is he more qualified than other applicants?

Both of these "kids" showed very poor judgement. This is acceptable if you are a frat boy urinating in a pool. It is completely unacceptable for chief law enforcement officials.

LPMFB24-this issue has nothing to do with officers thinking they are above the law. It is whether the results of a polygraph are admissable in a court of law, which they are not. The defense was trying to get the portion of the recording and results admitted into testimony because the results were inconclusive. In other words, this portion of the tape and results help the defense.

But go ahead and get angry over this decision and make accusations of special treatment-it is your reading comprehension that is the joke.

OK, I am not one to pile on another post, but that is just what I mean. You are right, it would not be news if it was not for the movie star connection. I ask you though, does that mean it should not be a big deal? I am willing to bet that similar actions have taken place before and to people of less means to get into the news. Did they just get caught this time. I think he is telling the truth, he does not think he did anything wrong, and that is what is wrong.

This wouldn't even be in the news or followed so closely if it didn't have anything to do with a celebrity. Also, did the surrogate file the charges or the DA?

if all of you take a moment to look back a few weeks ago, a kid said he was there to rob the 7-11. then he said it was "just a joke". wonder who will be found guilty and not guilty.

LPMFB24 polygraph examinations and results are NEVER admissable no matter who the defendant. The reason: they are unreliable and subjective. It's obvious you have an adgenda and are anti-police, but at least make a knowledgable comment.

When "under color of authority" there are no Jokes. This is why you see signs at the aiport saying, jokes will put you in jail. Saying it is a joke when you say you have a bomb or when you are a police chief, never mind two police chiefs, is not a joke. So he broke into the house, snapped a few pics on his phone and "joked" about selling the items. OK, you still have a break in.

Why did they not let the jurors here the lie detector test? Oh that's right, cops are above the law. they can do what they want to do, nomatter what, Right? Guess not, because,

Carpenter said it was a joke, so, I understand now, the joke was on him.

When I hear people talk about these officers "getting off" and I say that instead of Not Guilty or inocent, It is not because they do not think they could have done it, most seem to think they could have done it, iy is because there is not enough evidence. This area has lived in it's own world for so long, we have become to accept this "old boy" system that is really no more than coruption and incometence. We can no longer accept the old standards of the vally if we want people to come to or back to this area and live and invest and grow our community. We must see that this goes far beyond if a local bully with a badge (another problem in itself) breaks into a persons home and see it as intolerable that anyone would even think a law enforcement officer of any rank would do something like this. Look at the news, not just this week but over the years, mayors, officers, city council members are in the news for actions that we just can't accept. Professionals need to

IF these senior officers are guilty then they should be punished according to the law. However prosecutors tend to be overzealous in their attempts to find cops guilty of any crime particularly if they have political ambitions as it makes them look tough on crime. No matter what the outcome it sheds a bad light on all the good decent officers who wear the badge and do protect and serve. Good cops have no sympathy for bad cops.
