OCDA Sued For Work Payment
By SHELLEY HANSON Staff WriterWHEELING - The Ohio County Development Authority is being sued by a company that claims the group owes it $36,686.
According to a copy of the complaint filed Oct. 9 in Ohio County Circuit Court, Hill Phoenix Inc., 709 Sigman Road, Conyers, Ga., claims it did not receive payment for work it did for and materials it provided to the OCDA.
Greg Stewart, authority treasurer/secretary, could not be reached for comment.
The complaint, case No. 09-C-339, alleges the authority breached its contract with Hill Phoenix "by refusing to make payments."
The OCDA "has received and retained benefit of the materials provided to it, and as such Hill Phoenix is entitled to payment for such work and materials," according to the complaint.
The document notes the company, described as a Delaware corporation, wants to be paid in full, plus interest, and to be compensated for the value of materials provided to the OCDA. It also wants its court costs covered.
The complaint does not mention the type of work Hill Phoenix did for the OCDA, the type of materials it furnished or where the work was conducted.
However, according to the company's Web site, Hill Phoenix "designs, manufactures, sells and installs refrigerated display cases, refrigeration systems, power systems and walk-in coolers."

And to think the streets at the Highland are named Stewart Way, Warton Drive, Simms Blvd, and McCormick Lane. Hmmmmm. Where's Mackenzie Alley? Perhaps at GreaseMyHand Plaza??

I thought the Highlands was bringing "economic development"? They can't even pay their bills! Total debt at the Highlands is about $200 million. Annual rents are less than $2.5 million, from what I've been able to find. Even if the debt is at 2% interest, that is still $4 million per year. Even if you add in the sales tax revenue, I have a hard time believing that the Highlands can service its' debt, never mind expand or upgrade anything.

there are many more people who have not been paid still. I wonder how Mr.Stewart would feel if he did not get his paychcck for months? But don't try to ask, I am sure he will not be able to be reached!
