Recht: Give FOP The Signatures

The Fraternal Order of Police Lodge 38 now has the signatures of those seeking an election on Wheeling's two-officer per cruiser ordinance, thanks to a ruling by Ohio County Circuit Judge Arthur Recht.

"It screams out for public disclosure," Recht said, citing Section 81 of the Wheeling City Charter regarding petitions submitted to City Council. "It screams out to be tested."

Meanwhile, signature collectors George Jones and William Hefner want to be dismissed from the case involving them, Wheeling and the FOP because they believe city officials did not properly explain to them the meaning of the word "affidavit."

City Solicitor Rosemary Humway-Warmuth wanted to keep the signature pages away from the FOP. As the basis for her motion, Humway-Warmuth cited a Jefferson County, W.Va., Circuit Court case in which The Sheperdstown Observer sued Circuit Clerk Jennifer Maghan in an effort to force her to release a petition submitted by voters. After Maghan denied the newspaper's request, noting her office did not create the document, Circuit Judge David Saunders ruled in her favor.

Recht, however, did not seem to care what Saunders thought of the matter.

"Any other circuit court decision is not binding. ... There are 65 circuit judges in West Virginia. I don't care what the other 64 are doing - and so that there is no misunderstanding, I'm sure that they don't care what I'm doing," he said.

FOP attorney Joseph John has said that he has witnesses who will testify that they did not sign the petition, even though their signatures appeared on it.

After City Clerk Janice Jones certified 2,469 signatures to City Council in July, members voted unanimously in August to accept the petition. Humway-Warmuth then immediately filed suit against petition circulator George Jones in an effort to hold the election in May, rather than within 90 days as the City Charter seems to mandate.

After Recht allowed the FOP to intervene in the original lawsuit, John claimed Janice Jones and council should not have accepted the signatures because George Jones and Hefner did not adhere to the City Charter. John and the FOP claim some of the signatures were forged or improperly collected.

Now George Jones and Hefner have filed a motion, assisted by attorney Paul Harris, to dismiss them from the lawsuit. They claim city officials knowingly accepted the petition without adhering to the requirements of Charter Section 81 dealing with affidavits.

Regarding petitions submitted to the city, the charter states: "... there shall be attached thereto the affidavit of the circulator thereof stating that each signature was made in the circulator's presence. ..." Black's Law Dictionary defines "affidavit" as "a voluntary declaration of facts written down and sworn to by the declarant before an officer authorized to administer oaths, such as a notary republic."

"We submitted the petition to them (city) with our signatures at the bottom of each page. We thought that was good enough," George Jones said after the hearing. He noted the city accepted the petitions even though the charter states he and Hefner did not meet all the requirements.

Recht will hear a motion to remove George Jones and Hefner from the case at 3:30 p.m. Nov. 12 in his courtroom on the fifth floor of the City-County Building, 1500 Chapline St., Wheeling. A regular day of testimony in the case is scheduled for 8 a.m. Nov. 25 in the same venue.

Hey, they don't need 25-50. Just one more. Probably already have one sitting around. They could probably get a few more.

South Wheeling resident Dave Edge asked "What is the excuse for only having one patrol car..." Whg Police Corp Redford said the chief is responsible for patrols.

He should have added, but if we didn't have two per cruiser, we could have another cruiser patrolling just blocks away.

The FOP already had copies of the petition in hand. This was an attempt by the City to stop some people from testifying that their signatures were FORGED. The entire petition comes under suspicion now that Heffner and Jones are pulling their names off the petition due to them being too dumb to know they were swearing to it's validity by signing their names.

Let's be real about the real issue.

Meninblu says the city wishes one man per cruiser. Don't know if that is true or not, but it is about jobs.

Probably every other area in the US operates with one per cruiser.

The police deserve a lot of respect for doing the job they do.

They deserve none for making Wheeling the only area in the US with this law, and costing the taxpayers millions over the years, and/or reduced safety becuase of it.

The FOP wants the list precisely to see who signed it. If you own a business and you signed it expect a very slow response time if trouble occurs. If you are a citizen who signed it, expect a late night ambigious caller to chide you for being pro-crime.

From sleazes like State Senator Edwin Bowman's pay offs by Mountaineer Gamming to campaign contributions from out of state entities paying The State Supreme Court members for " access', West Virginia is a one party socilist welfare corrupt state!!!

First I do not see why the names can not be open to the public. But, I know that signers have already been harassed for signing with phone calls, are these from FOP members, I do not know, but seems so. I think it is all an embaressmente for the city, the police and the FOP. Americans are not afraid of making the system of democracy work. I know this is an unpopular thought, but if you are a working that has the city, state, federal seal on your pay check, your boss is the voter

I have never been arrested. I have just been an observor of how the police operate in general for years and I can tell you the bash down the door, throw the suspect on the ground while kneeling on their chest type of policing is why so many law abiding people loathe to even see you behind them as they drive. You guys make your jobs sound so dangerous but YOU ARE ARMED! Most of us citizens don't have the safety of a gun at our side and we still make it somehow.

The FOP wants the list so they can see who signed it. If you don't think the small minded yokels who make up a good portion of any Police Department won't use such a list to determine who is not blindly falling for their propaganda, you are an idiot.

King.. It has been a long time since a Wheeling Officer has been killed. But do you think that mabie having back up sitting beside you just might have something to do with that. How easy it is to hide behind your computer screen and call a Police Officer a p ussy. Sorry your arrest did'nt go the way you wanted. Alot of our officers work part time in the small towns surrounding Wheeling in, yes you guessed it a one-man cruiser. It has nothing to do with fear it has to do with common sense, which you are greatly lacking. Ask the Deputies and Troopers you love to throw in our face it they would like to have their back up sitting next to them and I think you would find that they would. I admit that this is about jobs and safety, and not our courage or charecter.

wvjeeper.. What you state is true if the city was being truthful about their intentions. The city wishes one man in the same number of cruisers. Same coverage less officers= the city saves money at the Officers expense. Do you honestly think that the city is going to buy 25 to 50 cruisers to make this happen?

maybe my understanding of this issure is cloudy. won't less officers per car mean more covarge? that is good for the city right? state troopers are single, sheriff are singles. what gives?

See, folks? Bill Hefner was too busy trying to get his name in the paper than to FOLLOW THE LAW which is easily explained in the City Charter.
